Breaking Off Road Act Laws in your Area

Here is my Area

What happens if I break off-road vehicle laws?
Generally fines for offences under the off-road vehicle act range from 172.50 to 604.50, but in some cases a judge may impose a fine of up to $20,500

Offences include, but are not limited to:
Operating without a helmet
Operating an unregistered vehicle
Operating without insurance (for all-terrain vehicles and snowmobiles)
Operating within 7.5 metres of a highway
Failing to show officers required documents
 
Infractions/Penalties

That's some stiff fines...In my area they would have to have a fulltime officer to control those laws.

Around here things are still pretty lax.  If you're crusing down the highway you're asking for trouble, but on the secondary roads and gravel they'll usually just warn you.  This whole area is nothing but farming so lots of ATV's and SXS's running around that are ag related, so the idea here is to throw a shovel on your ride and if you get pulled over, they can't ticket you because you're "working on the farm"

 

I illegally drive about 50 yards down my street to hit the farm, but after that I am on privately owned land for miles and miles, so thus far riding on the highways hasn't been an issue for me.  Back during the flood of 2011 I did have to take the highway for 1/4 mile or so to go around a flooded ditch, and a sheriff lit us up and followed us into the pasture.  We told him we were just going from one farm gate to the other and he said "Yall can't have those on the highway" and left it at that.

Wow ,Mel , sounds like they don't play up there ----

 

So if you were to get about 10 tickets at one time , it cold get expensive ---- ^

 

my ex-neighbor got like 13 at one time , he ran from the sheriff with his CFMoto in to the woods  , was at night , they wanted him bad , they brought out the helicopter with infra-red and dogs and got him , he was beat up really bad , they said he resisted and charged him for the beatin he got  , LOL

In my area I didn't know there were any off road rules.  I suppose there are, but for things I probably wouldn't be doing anyway.

 

I think most of my riding is in the National Forest or something, so it would have to be the forest service or someone who got after me, 

 

I did encounter one Sheriff on my last ride this year, and a couple forest service trucks on the high trail during the summer.  But they either didn't stop or if they did they just wanted to socialize and get information.

 

There are signs up about cattle poaching, $20,000 reward.  I have no idea if that is still an issue or not but I suppose those guys are more interested in that than any atv.  But around here most or almost all would be legal all around in any case. 

 

It's only been one year for me out there so far, so I haven't seen or head much.

 

Just one of my neighbors dog got caught in a trap that was basically on, or very close to the trail, so the dog owner objected and wanted to confront the trapper who happened to be my next door neighbor.  Confront not about trapping, but about trapping on or close to the trail.  He admitted it was winter and no one was up there much, but ...  It turned out the trapper had moved out, and a Sheriff's deputy moved in.  So he said it was probably better that no one answered the door when he went to confront the trapper. 

 

This was the same neighbor and dog team who had a story about the dog confronting and facing off with a sheep out on the trail, near a drop off.  This when the neighbor was still attached to the dog on the leash.  The sheep squared off and rammed the dog, knocking him down the drop off and causing the owner to fall with him for a ways.  He had the banged legs and arms to prove it.  (The neighbor, not the dog).  I suppose the dog was no worse for the wear on the ramming, the trap, and the fall.  It's a big dog.

Depending where I am ,  there are always several agencies that can stop and ticket me  , kind of like overlapping jurisdictions , like where I live , you got State Troupers ,Saint Tammany Sheriffs , Slidell Sheriffs , Wild Life and Fisheries ,  Federal Game Agents , Dept of Agriculture and Game Officers (  my buddy's wife is one of them , if you say sell or  ship alligator meat , oysters , fish in or  out the state without proper documentation , they get involved , and that isn't nice ) , Coast Guard ( usually they will only mess with you for boating violations , unless you get real stupid with fish or game , then they will hold you for the Wildlife , also drinking while operating a  boat they call the sheriff in , after towing you and your boat in ) ---- on the other side the lake in Orleans Parish , you got Levee Board Sheriffs, Orleans Parish Criminal Sheriffs , New Orleans Police added to the mix

Mel's fines are for driving on crown land or the atv clubs and snomobile trails, they can't fine me for no helmet, license, insurance or trail pass on the farm here or on private land.

The only places around here that have rules are the national forests. I went there last year one time and there were alot of around the campfire beer in hand stories about a guy that was on a rzr1000s on trails that are for 50" wide trail models only. He was drinking. No helmet. Had a kid with him. Was off trail and his rzr got impounded and he had racked up 1500 dollars in fines. Plus towing and impound fee he was over 2k for one stupid decision. Oddly enough for us to get our trail pass we had to ride into a "little town" according to locals you ride right in no problem. We ended up on way bigger roads then i felt comfortable with. If it wasnt for i had zero idea where we were i would have turned back. We ended up on a road with a 55 mph speed limit and that really freaked me out. Lots of cars. But everyone pretty much looked like it was a normal everyday thing. Still not sure if we took the correct way or not. But we got there and back and i was glad to hit some dirt trails.

I got nailed two years ago for no helmet.. $155 fine.

 

So we were bush camping & packing up. Going to leave early the next morning. It was around 830pm & I told my wife one more quick rip up before I load it onto the truck. She asked where my helmet was? I said naw its ok, Ill be back in 5mins.. 2 mins down the road I went to turn down to a brook, & who comes around the corner? Fish cops.... He escorted me back to my campsite, verified my reg & insure. I showed him my helmet & all. He said even though I was co-operative, he had to give me the ticket as his supervisor told them that because it was a long week end no exceptions...

There aren't any rules here that are ever enforced unless the rider is doing something dangerous or foolish that could cause others to be harmed. Young kids ride double and three-up around town, no helmets, and no one cares. I have never seen anyone pulled over riding an ATV or SxS around here. Now sleds out on the state trail system... thats another matter entirely. Folks are pulled over out there by the DNR trail cops all the time. The dirtbags set up traps for them out there. But everywhere else we ride as we please, wherever we please. I have neighbors that take their kids to church on an ATV. No kidding! 🙂

wow...amazing the number of laws...  round our place, yeah, the biggest law breakers are the guys that think it's ok to ride on other people's land...I think it's $400 or $450 now if you can catch em and ask em nice to wait til the deputy arrives...which ain't gonna happen..trail cam pics/videos definitely help with after the fact prosecutions.

98% of my 4wheeler riding is on my own property, occassionally going with family to an ATV park...so obey their rules..pretty much just helmit.

 

on occassion we have neighbors that take to our small neighborhood street..but that's them going from driveway down to visit neighbors..not tearing back n forth...snow/ice, as rare as that is here, becomes a big neighborhood party, so folks driving to visit can include the quads.

 

I have a couple pictures of me with older grandkids on the Fourtrax, but that's sitting there, when we ride them, their grandma makes em wear the helmit..and trust me, her 'fine"  is much more punitive than the cops would be. (grin)

Man,they don't mess around where you at Mac.All those old boys down my way riding up and down the highway would be broke,bet they wouldn't do again after getting one of those tickets.

Yeah Mel, that's the difference between a provincial government that see's the tourism benefits from ATV's and Snowmobiles and supports the industry, vs. a a government that clearly doesn't care about ATV or Snowmobile riders. Oh well. Luckily the fines don't seem to be strictly enforced.

WOW!  We have literally not laws concerning ATV's/UTV's.  Well not entirely true. We buy them.  We take the title down to the DMV, they fill out the information for a registration, print one off, we pay a one time fee of $180.00 and receive a permanent license plate and a permanent off road sticker for that particular machine for as long as we own it.  Requirements on our part? working headlight, at least one tail light, horn, 1 rear view mirror. lighted license plate holder with current plate, off road sticker/decal placed somewhere visible on the machine.This makes the machine street legal. Helmets required for those 16 and under, no riding double unless it is a factory mandated machine (supposedly) never have gotten a second look while riding with kids as long as they have a helmet.  With a licensed street legal machine we can ride anywhere we want, in town, city streets, county roads,and highways as well as all legal off road Forest service trails. If I want to take my atv to the grocery store I can.  As long as we are following posted speed limits it is not an issue. pretty spoiled that's for sure.

FF , I would bet that you have never been pushed out of a "stuck"  from the rear or ever will be -----  That license plate would not last long for me

Lol, I'm sure it wouldn't,  the first time I saw somebody do that on a video I was shocked.👀 that's crazy thought that's what winches were for lol. 😉

LOL.  Yep.  Front and back racks around here are all bent up from pushing and being pushed.

Yikes! Can't imagine doing that to my machine LOL!  I guess it  Comes from  Growing up at not having much. I'm the youngest of 6 kids and just saw dad work so hard to keep a roof over our head food on the table. There were kids all  Around us That had motorcycles and  Toys that they didn't take care of, I always had it in my mind to take care of what I had. Plus the fact that we just don't have that type of riding here, the trails are close down late in the fall till springtime so that they don't get torn up . Just a difference in where we live and the type of riding that is available to us Tyrion I would buy being pushed or pushing someone out if they weren't my machines lol. It does look like fun
